Baden-Württemberg:

In garden house areas, such as allotments, no building permit is required. Outside, the volume may not exceed 20 m³, indoors 40 m³. In addition, no toilets, fireplaces or lounges may be integrated into the house.

Bavaria

If no more than 75 m³ are rebuilt and the house has no fireplace, the arbor is license-free. Even in allotment gardens you do not need a building permit. This looks different outside of the development plan area: A permit is required here.


Berlin

Again, nothing goes outside the building area without permission. Within this, the volume may only be 10 m³☺. More than a small shed is in the federal capital without official permission so not in it.

Brandenburg

Here are all arbours, which are within the development plan area, up to a volume of 75 m³ approval-free. In allotment gardens, the cottage may have 24 m² of floor space including a patio.

Bremen

In the interior, houses are subject to up to 30 m³ volume, outdoor up to 6 m³ no permit. If there is no fireplace, a single storey house may be 10 m "tall.

Hamburg

Here, the rebuilt volume limit is 30 m³. A building permit is always required if you want to build the house outside a built-up area.

Hesse

Again, the volume of space may be 30 m³. If the house has a common room, a fireplace or sanitary facilities, a permit is required.

Mecklenburg-Vorpommern

Even in this federal state, at most, a small shed is approved, because the upper limit of the converted area is 10 m³. If the cottage is to be built outdoors, nothing works without official approval.

Lower Saxony

Here, the regulations are less strict, up to 40 m³ of room volume are permitted without authorization. In the outdoor area are up to 20 m³ license-free.

North Rhine-Westphalia

Again, everything that is larger than 10 m³ volume must be approved by the authority. In the outdoor area, all the arbors are subject to approval.

Saxony-Anhalt

Here the same strict regulations apply as in Saxony. Even indoors, a garden house with a volume of more than 10 m³ is subject to approval.

Schleswig-Holstein

Outside, the volume of the room may be 10 m³, indoors 30 m³, everything above is subject to approval.If you are planning a toilet, fireplace or common room, a permit is also required.

Thuringia

In the outdoor area, unfortunately, nothing goes without a permit, indoors you may at best build a small device house with 10 m³ enclosed space without official permission.

And what about the neighbors?

Even in the border area, it is important to note the building code of the countries. This is only allowed for buildings no more than three meters high, and then only if the total length of the garden shed does not exceed nine meters. This also applies only if no lounge, no fireplace and no sanitary facilities are integrated into the house. If this is the case, at least three meters distance to the property boundary must be kept.

Due to the non-uniform legal situation in the federal states, it is always advisable to contact the authorities before buying or planning a self-built garden shed.
